La ruina en el ámbito de la edificación : la normativa en la Comunidad Valenciana

Abstract

[ES] El presente Trabajo de fin de máster (TFM) trata sobre el estudio y análisis del marco normativo vigente que regula la situación de ruina en el ámbito de la edificación, focalizado en la Comunidad Valenciana, a fin de entender el concepto de ruina, así como su proceso de declaración, y sus efectos negativos para el entorno. Una vez definida la noción de ruina y su origen, se procede a analizar las tipologías de ruina, y en qué situaciones se declara según la normativa de la Comunidad Valenciana. Asimismo, se exponen los deberes de conservación y rehabilitación que hay que llevar a cabo, tanto por parte de los propietarios como de la administración, y los diferentes planes de ayudas públicas, para evitar que las edificaciones lleguen al estado de ruina. También se describe el proceso de declaración de ruina, los diferentes efectos que produce sobre los inmuebles, distinguiendo los que se encuentran protegidos o declarados de interés cultural. Por último, se aplica mediante un caso práctico la declaración de ruina de un edificio, y el uso futuro de la superficie.

[EN] The present Master's thesis is about the study and analysis of the current regulatory framework that regulates the state of ruin, focused on the Valencian Community, to understand the concept of ruin, as well as the process of declaring a building unsafe, and its negative effects on the environment. After defining the concept of ruin and its origin, the thesis proceeds to describe the typology of ruin, and in what situations a building is declared as such according to the regulations of the Valencian Community. Likewise, the thesis lists conservation and restoration duties that must be carried out by both the owners and the administration, and the different state aid plans to prevent the buildings from reaching the state of ruin. It also describes the legal process of declaring a building as ruin and the different effects it produces on real estate, distinguishing buildings that are protected or declared as objects of cultural heritage. Finally, the thesis describes the example study of the declaration of a building as ruin and the future use of the territory.
