Los procesos de integración de las cooperativas agroalimentarias. De la norma a la realidad. Especial referencia a la Ley 13/2013 de Fomento de la Integración Cooperativa

Abstract

[EN] Spanish agri-food cooperative movement is characterized by great economic, social and geographical development. However, among its main weaknesses it can be highlighted their significant fragmentation, with many entities of very small size, which places them in a situation of vulnerability in the market.

In this context, Law 13/2013, to promote associative integration, with the figure of the Priority Associative Entity (PAE), and RD 550/2014, which establishes the requirements and the procedure for its recognition, must influence the size of cooperative organizations.

Faced with this reality, this paper analyzes the potential achievement of the objectives set out in the Law 13/2013 (with its current configuration), to increase the size of Spanish agri-food cooperatives, which to date has had a limited aplication (only 6 entities have obtained the PAE recognition). For that purpose, it has been prepared a survey of the 274 Spanish cooperatives with largest sections. At the same time, it analyzes if the reason for such scarce application lies in the level of difficulty in reaching the minimum requirements established in it.

Through the survey, it has been studied:

- The expected degree of achievement of the four objectives of the Law, paying particular attention to the increase of the size of cooperatives according to their size,

- The level of difficulty to meet the requirements established to be recognized as a PAE.

[ES] El cooperativismo agroalimentario español se caracteriza por tener una gran implantación económica, social, y geográfica. Ahora bien, entre sus principales debilidades está la importante fragmentación de las mismas, con muchas entidades de tamaño muy pequeño, que las posiciona en una situación de vulnerabilidad frente al mercado. En este contexto, la ley 13/2013, para promover la integración asociativa, con la figura de la Entidad Asociativa Prioritaria (EAP), y el RD 550/2014, que establece los requisitos y el procedimiento para su reconocimiento, debe de influir en el tamaño de las organizaciones cooperativas. Ante esta realidad, por medio de una encuesta realizada a las 274 cooperativas españolas con secciones de mayor tamaño, analizamos la potencial consecución de los objetivos planteados en la ley (con su actual configuración), para incrementar el tamaño de las cooperativas agroalimentarias españolas, ya que hasta la fecha ésta ha tenido una acogida limitada (tan solo 6 entidades han obtenido el reconocimiento). Al mismo tiempo, se analiza si la razón de tal escasa aplicación se encuentra en el nivel de dificultad en alcanzar los requisitos mínimos establecidos en la misma. Del análisis de la encuesta, hemos estudiado: - El grado de alcance esperado de los cuatro objetivos de la ley, prestando especial interés en el incremento de dimensión para las cooperativas en función de su tamaño, - El nivel de dificultad para alcanzar los requisitos establecidos para reconocerse como EAP
