El testamento y la futura reforma del Código civil en materia de discapacidad: algunas reflexiones

Abstract

[EN] Law 26/2011, of 1 August, on the adaptation to the International Convention on the Rights of Persons with Disabilities (BOE No. 184, of August 2, 2011) indicated the legal adaptation of the legal system to comply with the indicated in the Convention on the Rights of Persons with Disabilities, made in New York on December 13, 2006, and ratified by Spain on November 23, 2007 (BOE No. 96, of April 21, 2008). That is why, in order to carry out the appropriate modifications, the Draft Bill amending the civil and procedural legislation on disability matters affects the Civil Code in matters of succession. In the present work we will study the reform that affects the will and the disability, especially the capacity to test and be witnessed in the will, the form thereof, and the granting in the case of people with visual disability, among others. issues such as the use of mechanical or electronic means for its drafting, taking into account new information and communication technologies (ICTs) that can be suitable tools for adaptation and accessibility in the field of disability. This will allow us to reflect on these issues and will try to provide some solution of application in the Spanish legal system in cases of discussion.

[ES] La Ley 26/2011, de 1 de agosto, de adaptación normativa a la Convención Internacional sobre los derechos de las personas con discapacidad (BOE núm. 184, de 2 de agosto de 2011) indicaba la adaptación normativa del ordenamiento jurídico para cumplir con lo indicado en la Convención sobre los derechos de las personas con discapacidad, hecho en Nueva York el 13 de diciembre de 2006, y que fue ratificado por España el 23 de noviembre de 2007 (BOE núm. 96, de 21 de abril de 2008). Es por ello que para realizar las modificaciones oportunas el Anteproyecto de Ley por la que se reforma la legislación civil y procesal en materia de discapacidad afecta al Código civil en materia de sucesiones. En el presente trabajo se estudiará la reforma que afecta al testamento y la discapacidad, especialmente se atenderá a la capacidad para testar y ser testigo en el testamento, la forma del mismo, y el otorgamiento en el caso de personas con discapacidad visual, entre otras cuestiones como la utilización de medios mecánicos o electrónicos para su redacción, teniendo en cuenta las nuevas tecnologías de la información y comunicación (TICs) que pueden ser herramientas idóneas para la adaptación y accesibilidad en materia de discapacidad. Ello nos permitirá poder reflexionar sobre estas cuestiones y se intentará aportar alguna solución de aplicación en el ordenamiento jurídico español en los casos de discusión
