LAS VINCULACIONES SINGULARES DERIVADAS DE LA CARTOGRAFÍA DE RIESGO HÍDRICO

Abstract

[EN] Royal Decree 638/2016 by which the Regulation of the Hydraulic Public Domain is modified, introduces an unprecedented singular link that affects the flood and preferential flow areas determined in the National System of Cartography of Flood Zones. This linkage involves the ad casum alteration of the zoning conditions established in the corresponding management plan, in such a way that they generally entail a reduction in urban development or a restriction of uses. Such impact can be a significant detriment to the value of a specific property, compared to those of the rest of the area and, consequently, generate the corresponding right to compensation that restores discriminatory treatment.

[ES] El Real Decreto 638/2016 por el que se modifica el Reglamento del Dominio Público Hidráulico, introduce una inédita vinculación singular que afecta a las zonas inundables y de flujo preferente determinadas en el Sistema Nacional de Cartografía de Zonas Inundables. Esta vinculación supone la alteración ad casum de las condiciones de zonificación establecidas en el correspondiente plan de ordenación, de tal manera que conllevan generalmente una reducción del aprovechamiento urbanístico o una restricción de los usos. Tal impacto puede suponer un apreciable detrimento del valor de un inmueble concreto, en comparación con los del resto de la zona y, en consecuencia, generar el correspondiente derecho a una indemnización que restituya el trato discriminatorio.
