PRESUPUESTO BASE DE LICITACIÓN EN LOS CONTRATOS DE OBRA Y SERVICIOS: IMPULSO DE LA TRANSPARENCIA EN SU DEFINICIÓN

Abstract

[ES] El Presupuesto Base de Licitación (PBL) representa la cantidad económica que asigna el órgano de contratación a un determinado proyecto o servicio y que sirve como presupuesto de referencia en un proceso de licitación. Según la legislación española, el PBL debe incluir todos los costes que intervienen en el proceso de contratación con una cobertura suficiente de las obras o servicios a ejecutar y con ausencia de enriquecimiento injusto. Sin embargo, en la actualidad, la definición del PBL de los contratos del sector destaca por su falta de transparencia respecto a los costes que engloba, derivando en constantes impugnaciones por parte de los licitadores en búsqueda de la claridad, calidad y precisión en la definición de dicho presupuesto. Por tanto, la presente investigación plantea un análisis de la estructura del coste con el objeto de confeccionar el PBL en un contrato público de obras o servicios; examina sus componentes desde el punto de vista de su naturaleza y de su origen; y, establece el marco teórico conceptual necesario para que el desglose del PBL recoja todos los costes que constituyen el objeto del contrato

[EN] The estimated cost represents the economic amount assigned by the procurer to a specific project or service and serves as a reference budget in a bidding process. According to the Spanish legislation, the estimated cost is named ¿Presupuesto Base de Licitación¿ (PBL) and must include all the costs involved in the contracting process with sufficient coverage of the works or services to be executed and with the absence of unjust enrichment. However, currently, the definition of the PBL in public procurement of the construction industry stands out for its lack of transparency regarding the definition of these costs, leading to constant objections by bidders in search of clarity, quality, and precision in the definition of the PBL. Therefore, this research proposes to analyze the cost structure in order to draw up the PBL in a public contract for works or services; to examine its components from the point of view of their nature and origin; and, to establish the theoretical conceptual framework necessary for the breakdown of the PBL to include all the costs that constitute the object of the contract
