Més ombres que llums. La gestió del patrimoni inmaterial a la Comunitat Valenciana

Abstract

[ES] Que el patrimonio inmaterial es una de la grandes aportaciones de las últimas décadas no tiene contestación. No obstante, resulta necesario realizar, concierta frecuencia por su naturaleza, un análisis sobre la aplicación que de las normativas de rango internacional se realizan para un determinado territorio. Con ese fin, el presente trabajo ha sido estructurado para perfilar aquellos puntos de consonancia y de distancia que pueden detectarse en una comparación que tome como nexos a enfrentar las últimas directrices establecidas por la UNESCO, especialmente la Convención para la Salvaguardia del Patrimonio Cultural Inmaterial, y aquello que queda recogido en la sucesivas leyes de Patrimonio Cultural Valenciano publicadas dentro de la Comunidad Valenciana. Dicho estudio ha dejado patente la cantidad de puntos débiles por falta de aplicación práctica que existen en aquellos cuatro puntos rectores que estable la UNESCO en cuanto a la gestión del patrimonio señalado. La Salvaguardia, Respeto, Sensibilización y Ayuda, a pesar de ser tenidas en cuenta a lo largo de los textos legislativos del territorio en cuestión por diversas razones no llegan a alcanzar una efectividad relevante.

[EN] That the immaterial heritage is one of big contributions of last decades it does not have answer. Nevertheless, it turns out necessary to realize, coordinates frequency for his nature, an analysis on the application that of the regulations of international range is realized for a certain territory. With this end, the present work has been structured to outline those points of agreement and of distance that can dectectarse in a comparison that takes as links of facing the last directives established by the UNESCO, specially the Convention for the Safeguard of the Cultural Immaterial Heritage, and that one that remains gathered in successive laws of Cultural Valencian Heritage published inside the Comunitat Valenciana.The above mentioned study has made clear the quantity of weak points for lack of application practic that exist in those four points governing that stable the UNESCO as for the management of the notable heritage. The Safeguard, Respect, Awareness and Help, in spite of being had in account along the legislative texts of the territory in question for diverse reasons do not manage to reach a relevant efficiency.
