Análisis de la maternidad subrogada como nueva tecnología en el ámbito biomédico y jurídico-filosófico: avance técnico, retroceso humano

Abstract

[EN] Surrogate motherhood is a question that has appeared in recent times, with increasing incidence, at present. The economic, political and media powers have brought a strictly technical concept to the public in order to familiarize them with this technique. This strategy has been based on the natural tendency to consider that any technological advance is good in itself, so that they have not been reviewed and made available to the citizens, in a reasonable manner, none of the issues that should be dealt with this technique. Thus, it is worth making a study of the regulations and jurisprudence of the assumptions that have been taking place and considering the reality that this formulation implies not only for the plaintiffs of this form of reproduction, but also from the prism of the woman who is going to create the child, as well as the position in which the child will remain after this process. The dignity of both the biological mother and that of the child discourages carrying out this type of practice since it only tries to satisfy an alleged right to be a father or mother, a right that has no legal consistency, since for this purpose other rights of perversion are perverted. The subjects involved and, especially, the dignity of both the pregnant mother and the child resulting from the process is passed over.

[ES] La maternidad subrogada es una cuestión que ha aparecido en los últimos tiempos, cada vez con más incidencia, en la actualidad. Los poderes económicos, políticos y los medios de comunicación han acercado a la ciudadanía un concepto, estrictamente técnico, con el fin de familiarizar esta técnica. Esta estrategia se ha amparado en la natural tendencia a considerar que cualquier avance tecnológico es bueno de por sí, de manera que no se han revisado y puesto al alcance de los ciudadanos, de forma razonable, ninguna de las cuestiones que deben de tratarse con esta técnica. Así, cabe hacer un estudio de la normativa y jurisprudencia de los supuestos que han ido produciéndose y considerar la realidad que implica esta formulación no solo para los demandantes de esta forma de reproducción, sino también desde el prisma de la mujer que va a gestar el niño, así como de la posición en la que quedará el niño tras este proceso. La dignidad tanto de la madre biológica como la del niño desaconsejan llevar a cabo este tipo de prácticas ya que únicamente trata de satisfacerse un supuesto derecho a ser padre o madre, derecho que no tiene consistencia jurídica, ya que para ello se pervierten otros derechos de los sujetos implicados y, especialmente, se pasa por encima de la dignidad tanto de la madre gestante como del niño que resulta del proceso.
