Fiscalidad de la familia en situación de crisis matrimonial

Abstract

[EN] The main purpose of this paper is to analyze the fiscal situation derived from the marital crisis. Throughout the study will be exposed the various tax treatments that may be given as a result of the agreements provided for in the regulatory agreement of Article 90 of the CC. Among them, the tax obligations derived from the maintenance pension; the compensatory pension; other charges agreed between the spouses; and compensation for marriage annulment of Article 98 of the CC.

[ES] El presente trabajo tiene como objeto principal analizar la situación fiscal derivada de la crisis matrimonial. A lo largo del estudio se expondrán los diversos tratamientos tributarios que se podrán dar como consecuencia de los acuerdos previstos en el convenio regulador del artículo 90 del CC. Entre ellos, las obligaciones impositivas derivadas de la pensión por alimentos; la pensión compensatoria; otras cargas pactadas entre los cónyuges; y la indemnización por nulidad matrimonial del artículo 98 del CC.
