La variedad vegetal y la biodiversidad ante los Objetivos de Desarrollo Sostenible

Abstract

[ES] El presente trabajo aborda el régimen jurídico de protección de las variedades vegetales y de la biodiversidad, dada su relevancia en el campo de la biotecnología verde y en la consecución del segundo de los Objetivos de Desarrollo Sostenible (ODS), que se propone principalmente poner fin al hambre y alcanzar la seguridad alimentaria, cuestiones fuertemente dependientes de la innovación agroalimentaria. Se aportará claridad a la legislación nacional e internacional, referida a los dos posibles sistemas jurídicos de protección de la variedad vegetal: el título de obtención vegetal y la patente. Se analizará su alcance, sus beneficios y limitaciones, así como los retos que enfrenta. Por tanto, se realizará un análisis documental y de contexto para plantear un problema jurídico internacional: ¿es apropiada la normatividad actual de protección de la variedad vegetal y de la biodiversidad para contribuir al objetivo de poner fin al hambre?

[EN] This research project addresses the legal regime for the protection of plant varieties and biodiversity, given its relevance in the field of green biotechnology and in achieving the second of the Sustainable Development Goals (SDGs), which is primarily intended to end hunger and achieve food security, issues strongly dependent on agri-food innovation. Clarity will be provided to national and international legislation, referring to the two possible legal systems for the protection of the plant variety: the plant variety title and the patent. Its scope, benefits and limitations will be analysed, as well as the challenges it faces. Therefore, a documentary and context analysis will be carried out to address an international legal problem: is the current regulations for the protection of plant varieties and biodiversity appropriate to contribute to the objective of ending hunger?
