Licencia para la Actividad de una Explotación de Cáñamo Industrial en el Término Municipal de Palmera (Valencia)

Abstract

[ES] El presente trabajo de fin de grado, tiene como finalidad la obtención de la Licencia de Apertura y la Compatibilidad Urbanística de la actividad del cultivo de cáñamo industrial para producción de semillas certificadas. Dado que, según el nomenclátor de actividades molestas, insalubres, nocivas y peligrosas está actividad no se encuentra descrita como tal (Cumple las condiciones establecidas en el Anexo III de la Ley 6/2014, de 25 de julio, de la Generalitat, de Prevención, Calidad y Control Ambiental de Actividades en la Comunitat Valenciana) está sujeta al régimen de comunicación de actividades inocuas, el cual tiene como finalidad posibilitar a los operadores económicos el ejercicio de una actividad sin necesidad de autorización u otro acto administrativo previo por parte de la administración, atendiendo a su nula incidencia ambiental. El cáñamo (Cannabis Sativa L.) lleva acompañando al ser humano como mínimo desde hace 8.000 años, fecha de la que datan los primeros tejidos encontrados hechos de esta materia. Desde ese tiempo hasta la actualidad el cultivo ha pasado de ser usado diariamente para gran variedad de aplicaciones a ser un cultivo prácticamente desconocido y tabú. Actualmente, el cultivo de cáñamo está experimentando un nuevo renacer dada la mayor concienciación ecológica de la población y el gran espectro de usos que esta planta puede tener, constituyendo así un verdadero nicho de mercado. A raíz de esto, iniciar un proyecto de cultivo cáñamo industrial de semilla certificada por la Unión Europea, es sin duda una opción interesante de desarrollo para el ámbito rural en los tiempos que corren, por ello, en el término municipal de Palmera (Valencia), en la Calle Bartolí n.º 8, se pretende implantar dicha actividad de forma ``INDOOR¿¿, beneficiándose de una nave industrial como invernadero. El cultivo del cáñamo industrial se realizará con semillas certificadas de variedades inscritas en el Catálogo común de variedades de especies de plantas agrícolas de la Unión Europea, según la Decisión 2004/842/CE de la Comisión, de 1 de diciembre de 2004. Y, la producción de semillas se realizará en base al Reglamento Técnico de Control y Certificación de Semillas de Plantas Textiles aprobado por Orden ARM/3372/2010. Por ello, con fin del cumplimiento de los considerandos anteriores y las necesidades agrícolas del cultivo, se diseña una instalación en el interior de la nave, basada en una estructura de pilares o guías de aluminio para alojar unas paredes de tableros estructurales de madera de 15 mm de espesor, formando así los habitáculos donde se alojarán las plantas y se ubicarán las instalaciones en materia hídrica, lumínica y ventilación, que precisa la planta del cáñamo. En el documento se abordan los aspectos formales y contenidos mínimos exigidos por la Escuela Técnica Superior de Ingeniera Agronómica y del Medio Rural, estableciendo en primer lugar una memoria, donde se incluyen los anejos que contendrán los cálculos pertinentes para la justificación de las instalaciones proyectadas en la nave y a su vez, se elaboran el resto de los documentos del conjunto del proyecto, como planos, documentos y presupuesto.

[EN] The purpose of this final degree project is to obtain the Opening License and Urban Compatibility of the activity of industrial hemp cultivation for the production of certified seeds. Given that, according to the nomenclature of annoying, unhealthy, harmful and dangerous activities this activity is not described as such (It meets the conditions set out in Annex III of Law 6/2014, of 25 July, of the Generalitat, of Prevention, Quality and Environmental Control of Activities in the Valencian Community) is subject to the regime of communication of innocuous activities, which aims to enable economic operators to exercise an activity without the need for authorization or other prior administrative act by the administration, taking into account its null environmental impact. Hemp (Cannabis Sativa L.) has been with human beings for at least 8,000 years, when the first tissues made of this material were found. From that time to the present day, the crop has gone from being used on a daily basis for a wide variety of applications to being practically unknown and taboo. Currently, the cultivation of hemp is experiencing a new renaissance given the greater ecological awareness of the population and the wide range of uses that this plant can have, thus constituting a real niche market. As a result of this, starting a project of industrial hemp cultivation of seed certified by the European Union, is undoubtedly an interesting option of development for the rural area in these times, therefore, in the municipality of Palmera (Valencia), in Bartolí Street n.º 8, it is intended to implement this activity in an ''INDOOR'' way, benefiting from an industrial building as a greenhouse. The cultivation of industrial hemp will be carried out with certified seeds of varieties registered in the Common Catalogue of varieties of agricultural plant species of the European Union, according to Commission Decision 2004/842/EC of December 1, 2004. And, the production of seeds will be carried out on the basis of the Technical Regulations for the Control and Certification of Seeds of Textile Plants approved by Order ARM/3372/2010. Therefore, in order to comply with the above considerations and the agricultural needs of the crop, an installation is designed inside the building, based on a structure of aluminum pillars or guides to house walls of 15 mm thick wooden structural boards, thus forming the rooms where the plants will be housed and the facilities will be located in terms of water, light and ventilation, which the hemp plant needs. The document addresses the formal aspects and minimum contents required by the Escuela Técnica Superior de Ingeniera Agronómica y del Medio Rural, establishing first a memory, which includes the annexes that will contain the relevant calculations for the justification of the projected facilities in the ship and in turn, the rest of the documents of the project as a whole, such as plans, documents and budget are prepared.
