Los elementos físicos de las fincas registrales: el dato de la superficie

The physical elements that define registered property are presented and analyzed from two perspectives: technical and legal aspects. From a technical viewpoint, the physical elements present in the physical description of pieces of property in the Property Registry (geographic location, boundaries, surface area, etc.) are shown, highlighting the surface area figure in rural registered property. From a legal viewpoint, the study focuses primarily on the surface area figure and its effect as an identifying feature of the registry, as well as its legal effectiveness, concentrating on increase or reduction of surface area (differences in land measurements) entries in the legal system.

Se presentan y analizan los elementos físicos que definen las fincas registrales desde dos aspectos: técnico y jurídico. Desde el punto de vista técnico se muestran los elementos físicos presentes en la descripción física de las fincas en el Registro de la Propiedad (situación geográfica, linderos, superficie,…), destacando el dato de superficie en fincas registrales rústicas. Desde el punto de vista jurídico se estudia fundamentalmente el dato sobre la superficie y su repercusión registral como dato identificativo, a la vez que su eficacia jurídica, centrándose en las inscripciones en el sistema legal de excesos y reducciones de superficie (excesos de cabida).
